Terms of Service
1. Acceptance of Terms
By creating an account or otherwise using Matilha (the "Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use Matilha.
Matilha is operated by Alfredo Manuel Rodrigues de Almeida Pascoal and Manuel João da Silva Rocha, acting jointly as private individuals (not through a registered company), available at matilha.app (the app itself runs at app.matilha.app). In these Terms, "we," "us," and "our" refer to them jointly.
2. Description of the Service
Matilha is a fitness-tracking social web app (Progressive Web App) that lets you:
- Log workouts, sets, and cardio sessions, and track personal records (PRs).
- Unlock badges and track training streaks.
- Connect with friends (your "Pack"), see their activity, and react to it.
- Create and join challenges with friends, and compete on rankings/leaderboards.
- Track optional biometric data (e.g., body weight) over time.
- Generate and share visual cards summarizing your workouts, PRs, and achievements.
Matilha is currently offered in beta. Features, badge criteria, ranking formulas, and other mechanics may change, be added, or be removed as the product evolves.
3. Eligibility
You must be at least 16 years old to use Matilha, consistent with our Privacy Policy. By using the Service, you confirm that you meet this requirement and that all information you provide is accurate.
4. Accounts and Your Responsibilities
- You are responsible for maintaining the confidentiality of your account (whether accessed via Google Sign-In or Magic Link) and for all activity that occurs under it.
- You must provide accurate information when creating your profile (e.g., username, display name).
- You are responsible for the accuracy of the workout data you log. Matilha relies on self-reported data; we do not independently verify weights, reps, or other metrics you enter.
- One account per person. You may not create multiple accounts to manipulate rankings, challenges, or badges.
- You must notify us promptly at matilhagym@gmail.com if you become aware of unauthorized use of your account.
5. Acceptable Use
When using Matilha, you agree not to:
- Post or share content (including your username, display name, profile photo, or custom exercise images) that is offensive, harassing, hateful, sexually explicit, or otherwise unlawful or inappropriate.
- Impersonate another person or misrepresent your affiliation with anyone.
- Manipulate, falsify, or artificially inflate workout data, rankings, leaderboard positions, challenge results, streaks, or badges ("cheating"), including through automated tools, scripts, or multiple accounts.
- Harass, spam, or abuse other users through social features such as friend requests, notifications, or reactions ("Howls").
- Attempt to access another user's account, data, or private information without authorization.
- Reverse-engineer, scrape, decompile, or attempt to extract source code or data from the Service beyond what is provided through normal use and any documented interfaces.
- Interfere with or disrupt the integrity or performance of the Service (e.g., attempting to overload, attack, or bypass its security measures).
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
We reserve the right to remove content, revoke badges/ranking positions obtained through prohibited conduct, or suspend or terminate accounts that violate these rules.
6. Intellectual Property
- Our content: The Matilha name, logo, badge designs, visual identity, card templates (workout/PR/profile/challenge cards), and the underlying software are owned by us or our licensors and protected by intellectual property laws. Nothing in these Terms grants you rights to our branding or software beyond using the Service as intended.
- Your content: You retain ownership of the content you upload or create, such as your profile photo (when not sourced from Google), custom exercise images, and the workout data you log. By uploading or submitting content, you grant us a limited, non-exclusive license to store, process, and display that content solely as needed to operate and provide the Service to you and, where applicable, to the friends/other users you choose to share it with (see our Privacy Policy for visibility details).
- You are responsible for ensuring you have the rights to any content you upload (e.g., custom exercise images), and for not infringing on the rights of others.
7. Third-Party Services
Matilha relies on third-party services to operate, including Google (for optional sign-in), Supabase (database, authentication, storage, and backend functions), and Vercel (hosting). Your use of these integrations may also be subject to those providers' own terms and policies. We are not responsible for the availability or performance of third-party services outside our control.
8. Disclaimers
Matilha is a workout-tracking and social tool, not a medical, health, or professional fitness service. Nothing in the Service constitutes medical advice, personal training, or professional fitness guidance. You should consult a qualified healthcare or fitness professional before beginning any exercise program, especially if you have any pre-existing health conditions. You are solely responsible for your own physical activity and any risks associated with it.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including (to the extent permitted by law) warranties of merchantability, fitness for a particular purpose, or non-infringement. As a beta product, Matilha may contain bugs, experience downtime, or change without notice.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Matilha and its operators (Alfredo Manuel Rodrigues de Almeida Pascoal and Manuel João da Silva Rocha) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or in connection with your use of (or inability to use) the Service — including any injury or health-related outcome resulting from workouts logged or performed in connection with the Service.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for death, personal injury caused by negligence, or fraud.
10. Termination
- By you: You may stop using Matilha at any time and permanently delete your account and data via Profile → Settings → Delete Account, as described in our Privacy Policy.
- By us: We may suspend or terminate your access to the Service if you violate these Terms, engage in prohibited conduct (Section 5), or if we are required to do so by law. Where practical, we will make reasonable efforts to notify you of the reason.
Provisions that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) will continue to apply.
11. Governing Law and Disputes
These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
If you are a consumer and have an unresolved complaint, you may also refer it to an alternative dispute resolution entity, such as a Centro de Arbitragem de Conflitos de Consumo (Consumer Dispute Arbitration Centre) in Portugal, or via the EU's Online Dispute Resolution platform where applicable.
12. Changes to These Terms
We may update these Terms from time to time, particularly as Matilha's features evolve during and after beta. We will update the "last updated" date at the top of this page, and for material changes, we will make reasonable efforts to notify you in-app before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
